These Terms & Conditions ("Terms") govern your use of the Vexa AI mobile application (the "App"), provided by Vexa AI ("we", "us", "our"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under 18, you must have a parent or guardian's permission.

2. The Service

The App lets you generate AI images and videos from text prompts and/or photos or videos you upload, browse a feed of pre-made templates, and save your results to an in-app Gallery. Generation requests are processed by third-party AI providers on our behalf (see our Privacy Policy).

3. Accounts

You can use the App as a guest or sign in with Google or Apple. You are responsible for maintaining the security of your account and for all activity under it.

4. Coins & Purchases

• Generations are paid for using "coins", a virtual, in-app-only currency with no monetary value outside the App and no cash redemption value.
• Coins are purchased in fixed packs via Apple's In-App Purchase system and billed through your App Store account.
• All purchases are processed and billed by Apple. Purchases are generally final; refund requests are handled by Apple under Apple's Media Services Terms and Conditions, not by us directly.
• If Apple reports a purchase as refunded or revoked, we may deduct the corresponding coins from your account, including into a negative balance, to reflect the reversed purchase.
• Coins have no expiration date set by us, but are tied to your account and are not transferable between accounts or redeemable for cash.
• We reserve the right to change coin pricing or the coin cost of a given generation at any time; changes will not retroactively affect coins you already own.

5. Your Content

• You retain ownership of any prompt, photo, or video you submit ("Input Content").
• You represent that you own or have the necessary rights to any Input Content you upload, and that it does not infringe any third party's rights.
• You grant us, and the third-party AI providers we use, a limited license to process your Input Content solely to generate your requested output and operate the App.
• Subject to these Terms, you own the AI-generated images/videos produced from your requests ("Output Content"), to the extent permitted by applicable law and by our upstream AI provider's terms.

6. AI-Generated Content Disclaimer

Output Content is generated automatically by third-party AI models. We do not review Output Content before it is delivered to you, and we do not guarantee its accuracy, originality, appropriateness, or fitness for any purpose. AI models can produce unexpected, inaccurate, or unintentionally similar-to-existing-works results. You are solely responsible for how you use Output Content, including compliance with any applicable law and any third party's rights.

7. Prohibited Uses

You agree not to use the App to create, upload, or request generation of content that:

• Depicts or sexualizes minors in any way
• Is intended to harass, defame, threaten, or impersonate a real person without consent
• Infringes another person's intellectual property, privacy, or publicity rights
• Depicts extreme violence, or promotes illegal acts, terrorism, or self-harm
• Violates any applicable law or third-party AI provider's usage policy

We reserve the right to suspend or terminate accounts that violate this section, with or without a coin refund, at our discretion.

8. Explore Templates

Templates shown in the Explore feed may be created by us or by third parties. Using a template to generate your own content does not transfer ownership of the template itself to you.

9. Termination

You may stop using the App and delete your account at any time from the App's menu. We may suspend or terminate your access if you violate these Terms. Unused coins are generally non-refundable upon voluntary account deletion, except as required by applicable law.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the App or generation results will be uninterrupted, error-free, or permanently available.

11. Limitation of Liability

To the maximum extent permitted by law, Vexa AI will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, or for any Output Content generated through the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms.
